Terms & Conditions

The contract that governs your use of the Airtech Mechanical Services website — with the important protections summarized in plain English at the top before the formal terms.

The quick version

By using this website you agree to these Terms. The Site is provided AS-IS and AS-AVAILABLE, and any estimator, calculator, chat, or AI-generated content on it is informational only — not a binding quote, not professional advice, and not a substitute for an on-site inspection. Any price you see on the Site is an estimate; the real price is set in the separate written service agreement you sign before we start work. To the maximum extent permitted by law, our total liability arising from your use of the Site is capped at US $100. Disputes are resolved by binding individual arbitration in North Carolina — you waive class actions and jury trials, but you may opt out of arbitration within 30 days of first using the Site by emailing office@airtechnc.com. North Carolina law governs. Small-claims court is preserved. Full terms below.

1. Acceptance of these Terms

These Terms & Conditions (the “Terms”) form a binding contract between you and Airtech Mechanical Services, Inc., a North Carolina corporation with its principal place of business at 204 Kale Rd, New Bern, NC 28562 (“Airtech,” “we,” “us,” or “our”). By accessing or using https://www.airtechnc.com (the “Site”), by submitting any form on the Site, or by otherwise interacting with the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Site.

2. Eligibility

The Site is intended for users who are at least eighteen (18) years old, or who use the Site under the direct supervision of a parent or legal guardian. By using the Site, you represent that you meet this requirement.

3. Description of services

Airtech is a licensed North Carolina HVAC contractor providing residential and commercial heating, ventilation, air conditioning, indoor-air-quality, geothermal, ductless mini-split, gas-piping, and related services in the Crystal Coast and Eastern North Carolina service area, including — without limitation — New Bern, Beaufort, Morehead City, Emerald Isle, Havelock, Jacksonville, and Wilmington. The Site is a marketing, information, and lead-capture platform; the delivery of contracted HVAC services is governed by the separate written service agreement described in Section 5.

4. AI-generated content, estimators, and interactive tools

The Site may present content generated or assisted by artificial intelligence, machine-learning models, and rule-based calculators — for example, size / cost estimators, chat responses, rebate-eligibility screens, and article summaries. This content is provided for informational and illustrative purposes only, has been reviewed by human staff, and does not constitute professional HVAC, engineering, medical, financial, or legal advice. AI-generated content may be inaccurate, incomplete, or out of date. Do not rely on it as a substitute for a written proposal issued by an Airtech employee following an on-site inspection.

5. Estimates & quotes are non-binding

Any pricing figure, range, calculator output, promotional dollar amount, rebate amount, or financing estimate displayed on the Site is a non-binding estimate intended to help you budget. The final scope of work, the final price, and the terms of any warranty become binding only when you and Airtech sign a separate written service agreement (a work order, proposal, or contract). An on-site inspection frequently changes scope and price. If we cannot in good faith perform the work at the estimated price, we will tell you before we start.

6. Not professional advice

Content on the Site — including learning-center articles, blog posts, FAQs, and estimator outputs — is provided as general educational information about HVAC systems and is not medical, legal, engineering, tax, or financial advice. For advice specific to your home or building, consult a licensed professional and, in the case of Airtech-installed equipment, rely on the written service agreement and the manufacturer warranty.

7. Intellectual property

All content on the Site — including text, graphics, photographs, illustrations, logos, service marks, trademarks, page layouts, and software — is owned by Airtech Mechanical Services, Inc. or its licensors and is protected by United States and international copyright, trademark, and other intellectual-property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your own personal, non-commercial use. You may not copy, reproduce, republish, modify, distribute, transmit, display, license, sell, or otherwise exploit any content from the Site without our prior written consent, except as expressly permitted by these Terms or applicable law. “Airtech,” the Airtech logo, and related brand marks are trademarks of Airtech Mechanical Services, Inc. Third-party marks (including Daikin) are the property of their respective owners.

8. Acceptable use

You agree that you will not, and will not attempt to:

  • Use the Site in any way that violates any applicable federal, state, local, or international law or regulation;
  • Interfere with, disrupt, damage, disable, overburden, or impair the Site or any server, network, or system on which it runs;
  • Circumvent, disable, or interfere with any security or access-control features of the Site;
  • Use any robot, spider, scraper, or other automated means to access the Site or to harvest data, other than public search engines complying with our robots.txt file;
  • Submit false, misleading, fraudulent, or spam contact submissions or service requests;
  • Use the Site to impersonate any person or misrepresent your affiliation with any person or entity;
  • Introduce any virus, trojan, worm, logic bomb, or other malicious or technologically harmful material.

9. User submissions

If you submit content to Airtech through the Site — including form submissions, photographs of your equipment, chat messages, reviews, or feedback (“User Submissions”) — you retain ownership of your User Submissions. You grant Airtech a worldwide, royalty-free, non-exclusive, sublicensable, transferable license to use, copy, store, transmit, and display those User Submissions solely for the purposes of providing services to you, operating and improving the Site, and — with your consent where required — publishing testimonials or case studies. You represent and warrant that your User Submissions are accurate, that you own or have the necessary rights to submit them, and that they do not violate any third-party right or applicable law.

10. Third-party services and links

The Site may include links to third-party websites, tools, or services, including our financing partner(s), Daikin, mapping providers, and review platforms. Those third-party resources are governed by their own terms and privacy policies. Airtech does not endorse and is not responsible for the availability, accuracy, content, or practices of any third-party site or service, and we are not liable for any loss or damage arising from your use of any third-party site or service.

11. Warranties disclaimed — Site is AS-IS

THE SITE, ITS CONTENT, AND ALL FEATURES ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITH ALL FAULTS AND WITHOUT ANY WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AIRTECH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. AIRTECH DOES NOT WARRANT THAT THE SITE OR ANY CONTENT WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY CONTENT (INCLUDING ESTIMATES, CALCULATOR OUTPUTS, REBATE INFORMATION, AVAILABILITY OR PRICING) IS ACCURATE, CURRENT, OR COMPLETE.

This Section 11 disclaims warranties about the Site. Warranties that apply to HVAC equipment we install or service — including the up-to-12-year parts & labor warranty offered with qualifying Daikin systems and any manufacturer or workmanship warranty — are governed by the separate written service agreement you sign with Airtech and by the manufacturer’s written warranty, not by this Section 11.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AIRTECH OR ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, USE, OR OPPORTUNITY, ARISING OUT OF OR RELATING TO YOUR ACCESS TO OR USE OF (OR INABILITY TO USE) THE SITE, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, STATUTE, OR OTHERWISE) AND EVEN IF AIRTECH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

AIRTECH’S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100). Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law. Some jurisdictions do not allow the exclusion or limitation of certain damages; in those jurisdictions our liability is limited to the smallest amount permitted by law.

13. Indemnification

To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Airtech and its affiliates, officers, directors, employees, agents, licensors, and service providers from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to (a) your misuse of the Site, (b) your violation of these Terms, (c) your User Submissions, or (d) your violation of any applicable law or of any third-party right.

14. Governing law and venue

These Terms and any dispute arising out of or relating to them or to your use of the Site are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Subject to the arbitration provision in Section 15, you and Airtech submit to the exclusive personal jurisdiction of the state and federal courts located in Craven County, North Carolina.

15. Binding individual arbitration; class-action waiver

Please read this Section 15 carefully. It affects your legal rights.

15.1 Agreement to arbitrate

Except for the carveouts in Section 15.4, you and Airtech agree that any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or any related interaction between us (a “Dispute”) shall be resolved by binding individual arbitration, and not in court. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules (or, if AAA is unavailable, by JAMS under its Consumer Minimum Standards) before a single arbitrator. The arbitration will be held in Craven County, North Carolina, or — at your election — by telephone or video, or based only on written submissions.

15.2 Class-action, collective-action, and jury-trial waiver

YOU AND AIRTECH EACH WAIVE ANY RIGHT TO A JURY TRIAL AND ANY RIGHT TO PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, REPRESENTATIVE ACTION, PRIVATE ATTORNEY GENERAL ACTION, OR CONSOLIDATED ACTION. The arbitrator may not consolidate more than one person’s claims or preside over any form of representative or class proceeding. If this class / collective / representative waiver is found unenforceable, then the entirety of this Section 15 (except this Section 15.2) shall be null and void, and the Dispute shall instead proceed in the courts identified in Section 14.

15.3 30-day opt-out

You may opt out of this arbitration agreement by sending written notice to office@airtechnc.com or to Airtech Mechanical Services, Inc., Attn: Legal, 204 Kale Rd, New Bern, NC 28562, within thirty (30) days after the date you first accept these Terms (or, if these Terms are materially amended, within 30 days after the amendment takes effect). The notice must include your name, address, and a clear statement that you wish to opt out. If you opt out, Sections 14 (Governing Law & Venue) still applies, and Disputes will be resolved in the courts identified there.

15.4 Carveouts

Nothing in this Section 15 prevents either party from (a) bringing an individual action in small-claims court for Disputes within that court’s jurisdiction, or (b) seeking injunctive or equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

15.5 Notice and 30-day informal-resolution period

Before initiating any arbitration or small-claims action, the party asserting the Dispute must first send the other party a written Notice of Dispute describing the nature and basis of the claim and the relief sought. Notices to Airtech must be sent to office@airtechnc.com or to Airtech Mechanical Services, Inc., Attn: Legal, 204 Kale Rd, New Bern, NC 28562. The parties will attempt in good faith to resolve the Dispute within thirty (30) days of the Notice; if they cannot, either party may proceed under this Section 15.

16. Pricing, promotions & financing

Pricing, promotional offers, rebate amounts, and financing terms shown on the Site are estimates only, are subject to change without notice, and may be subject to eligibility requirements not fully described on the Site. Financing offered through the Site is provided by an independent third-party lender (currently GoodLeap, LLC or a substituted lender we disclose at the time of application), is not extended by Airtech, and is subject to credit approval and to the terms and disclosures provided by the lender at the time of your application.

17. No guaranteed results

Airtech makes no representation, warranty, or guarantee that any particular repair, installation, or comfort outcome can be achieved in a single visit, at any specific cost, or within any specific timeframe. Every home and every system is different; our technicians will explain what is required after an on-site inspection.

18. Termination and suspension

We may suspend, restrict, or terminate your access to the Site at any time, for any reason or no reason, without notice or liability. Sections that by their nature should survive termination — including Sections 7, 9, 11, 12, 13, 14, 15, and 19 — will survive.

19. Miscellaneous

  • Entire agreement. These Terms, together with the Privacy Policy and any separate written service agreement you sign with Airtech, are the entire agreement between you and Airtech regarding the Site.
  • Severability. If any provision of these Terms is held unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
  • No waiver. Airtech’s failure to enforce any provision is not a waiver of that provision.
  • Assignment. You may not assign these Terms. Airtech may assign these Terms in connection with a merger, acquisition, financing, or sale of business assets.
  • Notices to you. We may provide notices to you by email, by posting a notice on the Site, or by any other reasonable means.
  • Headings. Section headings are for convenience only.

20. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date below and — for material changes — provide a more prominent notice on the Site. Your continued use of the Site after the revised Terms take effect constitutes your acceptance of them.
